Welcome to Garden Recall

Garden Recall turns your voice recordings and notes into an organized, searchable history of your garden. These Terms of Service (the “Terms”) explain the rules for using the Garden Recall mobile application, website, and related services (collectively, the “Service”).

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility and Acceptance

You must be at least 13 years old to use Garden Recall. If the law where you live requires a higher minimum age to consent to online services, you must meet that age requirement or use the Service with the permission of a parent or legal guardian.

By using the Service, you represent that you are legally able to enter into these Terms and that the information you provide is accurate and current.

2. Your Account

You may be required to create an account using an email address or a supported third-party sign-in provider. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.

Please notify us promptly at support@gardenrecall.com if you believe your account has been accessed without permission. We may require reasonable information to verify account ownership before assisting with account access, export, or deletion requests.

3. Your Garden Memories and Content

“Your Content” includes voice recordings, transcripts, written notes, edits, garden names, plant and variety information, observations, harvests, tasks, photos when supported, and other information you submit to the Service.

You retain ownership of Your Content. Garden Recall does not claim ownership of your garden memories.

You grant Garden Recall a limited, non-exclusive, worldwide license to host, store, reproduce, process, format, and display Your Content only as reasonably necessary to:

• provide, maintain, and secure the Service;
• transcribe recordings and organize your garden history;
• generate features such as Ask My Garden, Garden Briefs, tasks, summaries, and search results;
• provide support and troubleshoot technical issues; and
• comply with applicable law and enforce these Terms.

This license ends when Your Content is deleted from our active systems, except where limited retention is reasonably necessary for backups, security, fraud prevention, billing records, dispute resolution, or legal compliance.

4. AI-Powered Features

Garden Recall uses artificial intelligence to transcribe, organize, summarize, and retrieve information from your garden memories. AI-generated output may include plant names, varieties, dates, quantities, observations, tasks, summaries, suggestions, and answers to questions about your garden history.

AI systems can misunderstand recordings, miss details, or generate incorrect information. Garden Recall does not guarantee that transcripts, extracted information, summaries, reminders, or answers will always be accurate, complete, or current.

Garden Recall is a journaling and memory tool. It is not a substitute for professional horticultural, agricultural, medical, veterinary, chemical, legal, financial, or safety advice. You are responsible for reviewing important information and using your own judgment before acting on AI-generated output.

5. Permitted Use

Garden Recall grants you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

You agree not to:

• use the Service for unlawful, fraudulent, abusive, or harmful purposes;
• upload content that infringes another person’s rights or violates applicable law;
• attempt to access another user’s account or garden memories without authorization;
• interfere with, overload, damage, or disrupt the Service or its security controls;
• introduce malware, malicious code, or automated traffic that harms the Service;
• reverse engineer, copy, scrape, resell, or exploit the Service except where applicable law expressly permits it; or
• use the Service or its output to develop or train a competing product without our written permission.

6. Subscriptions, Billing, and Free Trials

Some features may require a paid subscription. The available plan, price, billing period, included features, and any introductory offer or free trial will be shown before purchase.

Subscriptions purchased through the Apple App Store or Google Play are billed and managed by the applicable platform. Unless stated otherwise at purchase, subscriptions automatically renew for the same billing period until canceled. You authorize the applicable platform to charge the payment method associated with your account at each renewal.

You may manage or cancel your subscription through the subscription settings of the platform where you purchased it. Deleting the app or deleting your Garden Recall account does not automatically cancel an active app-store subscription. Cancellation generally takes effect at the end of the current paid period unless the platform or applicable law provides otherwise.

Refunds, billing disputes, and changes to payment methods are generally handled under the policies of the platform that processed the purchase. We may change subscription prices or features prospectively, with notice where required by law or platform rules.

7. Account and Content Deletion

You may stop using Garden Recall at any time. Where available, you may delete individual recordings or garden information from within the Service and may initiate deletion of your account through the app or our designated web process.

Account deletion is intended to permanently remove your account and associated personal information from active systems, subject to limited retention described in our Privacy Policy. Account deletion does not automatically cancel an active subscription purchased through an app store; subscriptions must be canceled separately through the applicable platform.

Deletion may be irreversible. Before requesting account deletion, you should export or preserve any garden history you wish to keep, if an export feature is available.

8. Feedback and Suggestions

We welcome feedback, ideas, and feature suggestions. If you submit feedback, you grant Garden Recall permission to use it without restriction or compensation, provided that we do not publicly identify you as the source without your permission.

9. Garden Recall Intellectual Property

The Service, including its software, design, branding, logos, interfaces, documentation, and original content, is owned by or licensed to Garden Recall and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

“Garden Recall,” “Your Garden’s Memory,” and related names, logos, and branding may not be used without written permission.

10. Third-Party Services

The Service relies on third-party providers for functions such as authentication, cloud hosting and storage, AI processing, subscriptions, analytics, and crash reporting. Your use of certain third-party services may also be subject to their own terms and policies.

Garden Recall is not responsible for third-party products, services, websites, or platform decisions that are outside our reasonable control, including app-store billing, payment processing, or account access provided by third-party sign-in services.

11. Service Availability and Changes

We work to keep Garden Recall secure, useful, and available, but we do not guarantee that the Service will always be uninterrupted, error-free, or available on every device or in every location.

We may update, modify, suspend, or discontinue features to improve the Service, address security or legal requirements, manage costs, or respond to changes in third-party services. When practical, we will provide notice of material changes that significantly affect paid functionality.

12. Suspension and Termination

We may suspend or terminate access to the Service if we reasonably believe an account violates these Terms, creates a security or legal risk, abuses the Service, or threatens other users or the operation of Garden Recall.

Where appropriate, we may provide notice and an opportunity to correct the issue. We may act immediately when necessary to protect users, the Service, or comply with law.

Sections that by their nature should survive termination - including ownership, disclaimers, limitations of liability, dispute terms, and payment obligations - will remain in effect.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service or AI-generated output will be accurate, complete, reliable, secure, uninterrupted, or free from errors. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, Garden Recall and its owners, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, crop loss, plant damage, or business interruption arising from or related to the Service.

To the fullest extent permitted by law, Garden Recall’s total liability for all claims arising from or related to the Service will not exceed the greater of: (a) the amount you paid for Garden Recall during the 12 months before the event giving rise to the claim; or (b) USD $100.

The limitations in this section apply regardless of the legal theory and even if we were advised that damages were possible. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Garden Recall and its owners, affiliates, contractors, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from your unlawful use of the Service, your violation of these Terms, or Your Content’s infringement of another person’s rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.

Before filing a formal claim, you agree to contact us at support@gardenrecall.com and provide a reasonable opportunity to resolve the dispute informally. If a dispute cannot be resolved, it may be brought in a court with lawful jurisdiction. Nothing in these Terms limits rights that cannot legally be waived, including rights available under applicable consumer-protection law.

17. Changes to These Terms

We may update these Terms as Garden Recall grows or as legal, technical, or business requirements change. We will update the “Last Updated” date and provide additional notice when changes are material and notice is required.

Your continued use of the Service after updated Terms take effect means you accept the revised Terms. If you do not agree with an update, you should stop using the Service and cancel any active subscription.

18. General Terms

These Terms and the Privacy Policy form the entire agreement between you and Garden Recall regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
